Order Pronounced by Hon'ble Shri R. Satapathy

This is an application  under section 19 of the Adminstrative Tribunals Act,1985. The applicants 15 in number have filed this OA seeking a direction to implement the approved 6th Pay Commission recomendations under the DACP Scheme.

2. Mrs. Vedavalli Kumar has appeared for the applicants and Shri K. M. Venugopal has appeared for the respondents 3 to 5.

Congratulations,
I have gone through the order and also discussed with senior lawyers at RHC, the order is not complete,it has not said that doctors being treated as scientist and technologists is wrong and the merit promotion scheme applicable to them is wrong. They should be treated as DOCTORS only and so DACP is Applicable to Doctors.The order has not given any reasoning.
I am sure they will make a appeal in High Court.Let us hope for the Best.Best wishes and Regards.

Dear Doctors.
If we want that DACP and other service rules applicable to DAE/NPCIL
doctors at par with central govt./CGHS doctors, then we should file a case with the prayer that the doctors in DAE/NPCIL should be treated as DOCTORS ONLY And not as scietists and all rules applicable to central govt.doctors should be applicable to DAE/ NPCIL doctors. Un we do this we are not going to get any thing.

Dear Doctor Rathore,
Due regards to your seniority and wisdom,
I dont agree with your comment that unless doctors are treated as doctors ONLY, we dont get any benefit out of it.
Doctors work as Scientists, Colonels, Professors, Specialists, Medical OFFICERS, Registrars, Residents, Lecturers, Blah Blah and Blah. We teach, Command, Research, Treat, Admin etc. nowhere, there is a designation called as "Doctor". And it is neither questioned from a professor of a medical college if he should be considered as a doctor.
More so, apart from the benefits of being a medical doctor, like NPA etc., other benefits attached to the posts and designations like Rank Pay at par with non doctor army officers, CSD benefits and other benefits, Teaching allowances etc.
Many medical and dental colleges follow UGC benefits for teachers at par with University teachers along with provision of NPA to medical teachers, hence not denied the benefit of being a medical doctor even if a teacher (more evident in preclinical subjects without any clinical work)
IT IS NEVER ARGUED SIR, THAT A MEDICAL DOCTOR SHOULD BE TREATED AS MEDICAL DOCTOR ONLY , HENCE DENIED OTHER DUE BENEFITS ATTACHED TO THE POST, at least in my knowledge. If such precedence exists anywhere sir please enlighten me.
